Peter Jay's Will

The last will and Testament of Peter Jay of the town of Chenango, County of Broome and State of New York – I Peter Jay, considering the uncertainty of this mortal life, and being of sound mind and memory (blessed be Almighty God for the same) do make ordain and publish this my last will and testament in manner and form following – unto Harrison Jay and Peter Jay, sons of Hiram Jay, each the sum of ten dollars. The above legacies are to be paid out of my real estate if there is not enough of my personal after paying my just debts, and to be paid only in stock, or paid out in use(?) by my executors herein after named as applied to their use and benefit at such time here after as they should think will be most to their advantage.
I give and bequeath unto my dear wife Polly Jay all my household furniture, and also all the rest and residue of my personal estate that shall be left or remains after paying my debts and the aforesaid legacies. And I hereby empower and authorize my executors to sell and dispose at private sale or any part of my real estate, or of the timber thereon as shall be necessary to pay my debts, and to give any deed or deeds of conveyance for the same said real estate as situated in Chenango aforesaid and is a parcel of lot number thirty seven in Clinton & Meachem patent and described as follows – Beginning at a Stake and Stones in the south line of said lot at a distance of 20 chains from the south west corner thereof – thence running north 4 degrees east along a line of marks 16 chains 46 links to a stake and stones – thence south 89 degrees 35’ east 12 chains 15 links to a stake and stones – thence south 4 degrees west 16 chains 46 links to a stake in or near the Easterly side of the brook, and thence westerly along the south line of said lot to the place of beginning – containing twenty acres of land and fruittrees(?). I give and devise unto my said beloved wife, Polly Jay all my real estate, or all that shall not be sold by executors to pay my debts as aforesaid – and I hereby constitute and append Ezra Crocker and John Munsell of Chenango aforesaid executors of this my last will and testament, hereby revoking all former wills by me at any time heretofore made In witness whereof I have hereunto set my hand and affix my seal this 9th day of September A.D. 1842 (Signed) Peter Jay
